In general, to eligible for accident benefits your injuries or disabilities must arise - and be documented by a doctor - within 20 days of your accident. However, this time limit may be waived if you can show that your injury or disability was caused by the accident. ICBC may refuse to provide you with accident benefits if you didn’t notify them of your accident promptly, give them a written statement within 30 days, and apply for accident benefits within 90 days. However, you shouldn’t be denied benefits unless your failure to comply with these time limits has placed ICBC at a disadvantage in dealing with your claim. You may need to take ICBC to court to prove your accident caused your injuries and you’re entitled to accident benefits.
